1. Introduction
1.1 The subject of these terms and conditions is participation in the AY COINS PROGRAM ("Program"). The Program rewards your loyalty as an ABOUT YOU customer and grants you the opportunity to collect bonus points ("Coins") when purchasing goods, which can be redeemed for discounts in accordance with these conditions.
1.2 The organizer of the Program is ABOUT YOU SE & Co. KG, represented by ABOUT YOU Verwaltungs SE, which is represented by the Management Board Tarek Müller, Hannes Wiese and Sebastian Betz, Domstraße 10, 20095 Hamburg (hereinafter: “ABOUT YOU” and/or “organizer” and/or “we”).
2. Participation
2.1 Participation in the Program is free of charge.
Any natural person acting as a private individual and not on behalf of a company is eligible to participate, provided they are either 18 years of age or older, or at least 16 years of age and have the consent of their parents, guardian, or legal representative. ABOUT YOU reserves the right to request written confirmation of such consent.
2.2 All customers with an active ABOUT YOU account automatically participate in the Program. Separate registration is not required.
2.3 Participation in the Program is limited to one participation per customer. Participation in the Program may not be used for resale or for any other commercial purposes.
2.4 ABOUT YOU may refuse a customer's participation in the Program for objective reasons or exclude customers from participating in the Program for objective reasons. In particular, ABOUT YOU reserves the right to exclude customers who abusively or manipulatively influence the Program or interfere with its process.
2.5 Employees of ABOUT YOU and employees of companies affiliated with ABOUT YOU may participate in the Program, but may be excluded from individual promotions.

3. Collecting Coins
3.1 Coins can be acquired from the moment a customer account is registered.
3.2 Coins are collected automatically for every purchase. Coins are credited based on the total order value, including service costs and discounts.
3.3 Coins will be credited for all purchases, unless otherwise specified in the promotion or the General Terms and Conditions; this also applies to purchases where Coin discounts are applied.
3.4 For every Euro of the order value, the customer receives 1 Coin.
3.5 Coins are only redeemable in the country-specific shop in which they were acquired. Cross-country redemption or transfer is not possible.
3.6 For certain special promotions, Coins may be credited to a separately announced extent.
3.7 Coins received by the customer when purchasing an item will be deducted from their account if the item is returned. This also applies if it subsequently turns out that the conditions for crediting Coins were not met or have subsequently ceased to exist.
3.8 Redeemed Coins will also be refunded in the event of a return.
3.9 ABOUT YOU reserves the right to change, restrict, or exclude the crediting of Coins at any time, for example, within the scope of special promotions, or when other discounts or benefits are granted.
3.10 The customer can view their current Coin balance in their account at any time.
3.11 Collected Coins are personal and cannot be transferred to another person or another customer account.
3.12 If the customer cancels or deletes their ABOUT YOU customer account, all remaining Coins in the corresponding account will expire.
3.13 The customer is entitled to terminate their participation in the Program at any time by notifying Customer Service. Upon the effective date of withdrawal from the Program, all Coins collected until then will expire; further collection or redemption and access to the Coins will be excluded from that point on.
4. Coins Period and Coins Expiry
4.1 Coins are activated 30 days after an order.
Collected Coins remain valid for 180 days. After this period, the Coins will expire if they have not been redeemed by then.
5. Redeeming Coins
5.1 Customers have the option to redeem the Coins discount directly in the shopping cart by activation.
5.2 Customers cannot determine the amount of the discount applied. The entire discount available to the customer will always be applied.
5.3 The amount of the discount depends on the Coins collected up to the time of purchase.
5.4 Coins cannot be converted into cash and/or paid out.
5.5 After applying the Coins discount, the customer's Coin balance will be reduced by the Coins converted into a discount.
5.6 ABOUT YOU reserves the right to change, restrict, or exclude the redeemability of the discount, for example, within the scope of special promotions, or when other discounts or benefits are granted.
5.7 If an item for which a discount was applied is returned, the corresponding Coins will be credited back to the customer's account, provided they are still valid at the time of return. The validity of refunded Coins is 6 months from the original activation date. If Coins expire before the return date, they will not be refunded.
6. Changes and Termination of the Program
6.1 ABOUT YOU reserves the right to amend the terms of participation at any time and at its sole discretion. Such changes will come into effect 14 working days from the date on which the customer was informed of these changes via app, online, email (or a combination thereof). If the customer does not accept the new terms of participation, they can actively unsubscribe from the Program via Customer Service.
6.2 ABOUT YOU reserves the right to make minor changes to the Program and the terms of participation without prior notice, provided that these changes do not negatively affect customers.
6.3 ABOUT YOU also reserves the right to fully discontinue or replace the Program at any time, while safeguarding the legitimate interests of the customer.
7. Exclusion from Participation
7.1 Any misuse of the Program, proven or reasonably assumed fraud, non-compliance with the terms of participation, false information, or conduct detrimental to the interests of ABOUT YOU may lead to exclusion from the Program. If a customer is excluded, all collected Coins in the respective customer account will automatically expire.
8. Liability
8.1 ABOUT YOU shall be liable without limitation for intent, malice, and gross negligence, as well as in the event of personal injury and product liability.
8.2 ABOUT YOU shall be liable for damages in the event of a slightly negligent breach of a material contractual obligation (cardinal obligation) limited to the amount of foreseeable damage typical for the contract. In this case, ABOUT YOU shall not be liable for lost profits, indirect damages, consequential damages, and claims of third parties. Cardinal obligations within the meaning of these terms include, in addition to the main performance obligations, obligations whose fulfillment is essential for the proper execution of the Program and on whose compliance the customer may regularly rely.
8.3 Otherwise, any liability on the part of ABOUT YOU is excluded.
9. Final Provisions
9.1 German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
9.2 Should individual provisions of these terms of participation be ineffective in whole or in part or contradict statutory regulations or become void for other reasons, the validity of the remaining contract shall not be affected thereby. Void provisions shall be replaced by the provision that comes closest to the economic purpose of the ineffective one. The same applies to closing contractual loopholes.
